PRIVACY POLICY
INTRODUCTION
The
following constitutes the privacy policy of TalentGem, LLC (“TalentGem”) with
respect to its website, www.talentgem.com and its related websites (TalentGem Websites).
We urge you to read and review this privacy policy, and to email us any questions
or comments you may have. By using the TalentGem Websites, you expressly agree that
(i) you have read this privacy policy, (ii) that you understand the policy, and (iii) that you
accept it and agree to be bound by it. TalentGem reserves the right at any time
to modify this Privacy Policy. In the event of any material modifications of
this Privacy Policy,we will post a prominent notice on the TalentGem Websites.
GENERAL
STATEMENT
TalentGem
respects the privacy of its users, and will attempt to provide all users a
safe, secure and profitable experience. To insure your privacy, TalentGem
pledges the following:

TalentGem will only use personal information consistent with this Privacy
Policy;
2.
TalentGem will only store data in the United States.
3.
TalentGem will not link to Websites which it does not control. (TalentGem
disclaims any responsibility for the acts or policies of any Website to which a
user chooses to link from a TalentGem Website.).
COLLECTION
AND USE OF INFORMATION, GENERAL AND PERSONAL
Demographic
Information.
TalentGem may collect and utilize demographic and profile information for the
general purposes of operating its Website and personalizing and improving your
experience hereon. TalentGem will gather certain information about your use of
our site, such as the pages you view, and the services you access. During
your use, TalentGem may collect information about your computer hardware and
software, including your IP address, browser type, domain names, access times
and referring Web site addresses. In no event will this general information be
tied to your identity.
Contact
Information of Candidates. A
unique aspect of the TalentGem Websites is the ability for users to provide
referrals of candidates, job openings and/or hiring managers, and to
participate in the referral fees generated when placements are accomplished.
In order to accomplish placements (and to earn you money), users may provide
personal and/or confidential information about candidates (including
themselves), placement opportunities and hiring managers. TalentGem
uses the information received from referrers, candidates and hiring managers
for the purpose of matching candidates to jobs. With the candidates prior
permission, TalentGem may provide personal contact information to TalentGem
recruiters. Examples of this information may include an email address and
telephone number. A candidate will be provided the opportunity, to advise
TalentGem whether to automatically forward their contact information to a
TalentGem recruiter or whether to contact them first.
General Contact with a User. If a user has given consent, TalentGem
may also use the information it has gathered (i) to notify the user of products
and services available from TalentGem or other companies; (ii) to advise the
user regarding updates at the TalentGem Websites, (iii) to solicit your opinion
as to various matters; and (iv) to keep the user current as to new opportunities
and additional job postings. If a user provides feedback to TalentGem, then all
comments shall become the property of TalentGem, and may be used for such
purposes as TalentGem shall elect (including in marketing materials).
Disclosure
of Personal Information to Third Parties. TalentGem will not disclose personal information to third
parties, except for the following:
1. If you consent, TalentGem will
disclose information to TalentGem recruiting agents;
2. TalentGem will disclose
information to companies employed by TalentGem to perform services on its
behalf; and
3. TalentGem will disclose
information it believes it is required to disclose, by applicable law, or to
protect the safety of users or the public.
Statistical
Information. TalentGem
may share anonymous information which it has received from users and visitors
to TalentGem combined with similar information from other users and visitors.
This may include professional experience, qualifications and education, among
other things.
Confidential
Referrals. Users
shall have the right to provide referrals on a confidential and a
non-confidential basis. Users shall also have the right to delete or update
their profile at any time. If you choose to use this portion of our Websites,
we will contact the persons you have indicated, and depending on whether your
referral is confidential or not, we may provide them with your identity.
Resume
and Public Areas of the Websites. TalentGem
allows you to store your resume online, and elect that it be searchable or
not. Please note that any personal information posted in areas of the
TalentGem Websites open to the public may be collected and used by persons not
affiliated with TalentGem, in which case, TalentGem shall have no control over
how such information is used.
Right to Change Your Profile. At any time, a user may review,
correct, update or change its TalentGem account information. To do so, simply
log into your account and follow the prompts. You can delete your resume from
TalentGem’s online database, close your account at any time delete your profile
and close your TalentGem account.
While
we have taken commercially reasonable
technical and organizational steps to secure your personal
information from accidental loss and from unauthorized access, use, alteration
or disclosure, TalentGem cannot and does not guarantee
that such unauthorized use will never occur.

We will use commercially reasonable efforts to promptly answer your question or
resolve your problem.
TalentGem,
LLC is a California limited liability company with its principal place of
business at 1223 Wilshire Blvd., Santa Monica, Ca 90403. TalentGem LLC is
the legal entity which determines the purposes and means of processing the
information gathered at the TalentGem Sites.
